Who Registers Trademarks in Kenya?
The Kenya Industrial Property Institute (KIPI) is the government body responsible for trademark registration in Kenya. KIPI operates under the Industrial Property Act, 2001 and the Trade Marks Act (Cap 506).

Step 1: Conduct a Trademark Search
Before filing, conduct a clearance search at KIPI to check whether an identical or confusingly similar mark already exists in your intended class of goods or services. This is a critical step — filing without a search risks rejection.
Step 2: Classify Your Goods or Services
Trademarks are registered in specific classes under the Nice Classification (45 classes total). Examples:
- Class 35 — Business services, advertising, retail
- Class 41 — Education and training
- Class 45 — Legal services
- Class 25 — Clothing
- Class 30 — Food and beverages
Step 3: File the Application
Submit the trademark application to KIPI with:
- Completed TM Form 1
- Clear representation of the mark (logo/wordmark)
- List of goods/services and class number
- Applicant details (individual or company)
- Application fee payment
Step 4: Examination
KIPI examines the application to check it meets all legal requirements and does not conflict with existing trademarks. If issues are found, KIPI issues an examination report to which you must respond within the specified period.
Step 5: Publication in the Kenya Gazette
If the application passes examination, it is published in the Kenya Gazette for a period of 60 days during which third parties may oppose the registration.
Step 6: Registration Certificate Issued
If no opposition is filed (or an opposition is unsuccessful), KIPI issues a Certificate of Registration. The trademark is registered for 10 years and can be renewed indefinitely.

Trademark registration in Kenya typically takes 12 to 18 months from filing to certificate, assuming no objections or oppositions arise.
